Divorcing a Spouse in Dubai from South Africa

South Africa to Dubai international divorce case file

Short answer: you may be able to divorce a spouse who lives in Dubai through a South African court if either spouse is domiciled in the court’s area, or is ordinarily resident there and has been ordinarily resident in South Africa for at least one year before the case starts. The Dubai-based spouse must be served through a method authorised by the South African court. Before filing, compare South Africa and the UAE as possible forums because the choice can affect property, bank accounts, maintenance, children and the practical enforcement of the final order.

A South African spouse moves to Dubai for work. The marriage breaks down. One spouse remains in South Africa while the other has a UAE residence visa, income, bank accounts or property in Dubai. Where should the divorce be started, and will an order from one country work in the other?

There is no responsible one-line answer. A South Africa-Dubai divorce requires four decisions:

  1. Does a South African court have jurisdiction?
  2. Could a UAE court also hear the case, and which forum is strategically preferable?
  3. How will the Dubai-based spouse be served properly?
  4. Where will the order need to be recognised or enforced?

This guide explains the South African starting point and the UAE issues that should be checked with appropriately qualified UAE counsel.

Can a South African court divorce a spouse who lives in Dubai?

Yes, if the jurisdiction requirements in section 2 of the Divorce Act 70 of 1979 are met. In broad terms, a South African court has jurisdiction if either spouse:

  • is domiciled in the court’s area when the divorce starts; or
  • is ordinarily resident in the court’s area at that time and has been ordinarily resident in South Africa for at least one year immediately beforehand.

Your spouse does not need to be physically present in South Africa or agree to the divorce. But a Dubai address is not a shortcut around procedure. The court must be satisfied that it has jurisdiction and that the summons will be brought properly to the other spouse’s attention.

Should you file in South Africa or the UAE?

Where both countries present a possible route, speed should not be the only consideration. The better forum usually depends on the legal system governing the marriage, the location of the children and assets, the orders each court can make, and where those orders must ultimately be implemented.

Question South African route UAE/Dubai route to investigate
Jurisdiction Domicile or the statutory ordinary-residence test under section 2. UAE residence, domicile or work connections may be relevant under current UAE law.
Applicable family-law regime South African divorce law, with private-international-law questions for the property regime. The route differs for Muslim and non-Muslim couples and may involve choices of law.
Main assets Often practical for South African property, pensions, companies and evidence. May be practical where the principal property, accounts, salary or business interests are in the UAE.
Children The child’s best interests remain central, but jurisdiction and enforcement must be assessed. The child’s UAE residence, travel controls, custody and guardianship rules may be decisive.
Enforcement Direct for South African assets; foreign implementation may require additional proceedings. A Dubai order may be easier to execute against UAE assets, while South African assets may still require local steps.

The current UAE federal framework is not a single rule for every couple. The 2024 Personal Status Law and the civil personal-status framework for non-Muslims under Federal Decree-Law 41 of 2022 and Cabinet Resolution 122 of 2023 can lead to materially different routes. The 2024 law also contains UAE court-competence rules.

Article 1 of the 2022 civil law gives non-Muslim foreign residents scope to rely on their home-country law or agree to other UAE personal-status legislation, subject to the law’s terms and applicable conflict rules. That does not mean South African law will automatically be applied exactly as a South African court would apply it. Obtain current advice on the parties’ religion, nationality, residence, marriage and emirate.

Do not file in whichever country seems quickest until the likely financial and child-related consequences have been compared. If proceedings could be started in both places, timing and parallel litigation can materially affect strategy.

How are South African divorce papers served in Dubai?

A South African summons cannot simply be emailed or couriered to Dubai because that feels practical. Service outside South Africa generally requires advance court authority, commonly through an application for edictal citation. The proposed method must give a real prospect that the papers will reach the spouse and must respect the destination country’s requirements.

The court order may require a formal channel, a competent local service provider, delivery at a verified residential or work address, electronic notice as an additional safeguard, or a combination of steps. The correct route depends on the facts and the court’s directions. See our detailed guide to serving South African divorce papers abroad and the Department of Justice overview of the international legal-relations process.

Preserve the court order, translations, dispatch records, proof of delivery and any acknowledgement. Defective service can delay the divorce, enable a procedural challenge and make recognition of the eventual order more difficult.

What happens to property, bank accounts and business interests in Dubai?

A South African divorce court can determine rights between spouses within its jurisdiction, but it does not directly control a Dubai property registry, UAE bank, employer, company or pension institution. The distinction between the matrimonial claim and practical execution is critical.

Before settlement or trial, prepare an asset map recording:

  • UAE real estate and the registered owner;
  • bank, investment and cryptocurrency accounts;
  • employment benefits, gratuities and pension-type interests;
  • company shares, partnership interests and free-zone entities;
  • South African property, pensions, trusts and businesses; and
  • debts, guarantees and transfers between jurisdictions.

Then test whether the proposed South African order is sufficiently precise and what Dubai process would be needed to give it effect. The Dubai Courts execution guidance refers to execution of foreign judgments carrying the required executory formula. It also states that foreign documents used there must be legally translated into Arabic and certified through the relevant authorities. Requirements should be confirmed for the particular order and asset.

Our guide to cross-border asset division explains why disclosure, valuation, preservation and enforcement should be designed together. The broad commercial South African service is explained on SD Law’s international divorce page.

Will Dubai recognise a South African divorce order?

Potentially, but do not assume automatic recognition or execution. Recognition of the parties’ divorced status is different from enforcing a payment, transferring property, collecting maintenance or implementing parenting terms.

A UAE lawyer should confirm the current recognition route, required certification and translation, and whether separate proceedings or an executory formula are needed. Proper South African jurisdiction and service records will be important. If the divorce is granted in the UAE and must be used against South African assets, the reverse problem is addressed in our guide to enforcing a foreign divorce order in South Africa.

What if the children live in Dubai?

Children require a separate jurisdiction and welfare analysis. Do not treat a divorce order as an automatic authority to relocate a child, retain a passport or remove a child across borders.

Relevant questions include where the child is habitually resident, what existing orders or agreements apply, who holds custody and guardianship rights, whether the other parent consents to travel or relocation, and which court can make an effective order. UAE rules differ between legal regimes and can distinguish custody from guardianship.

Review the current UAE legislation applicable to the family with UAE counsel, and obtain urgent advice before travel if consent is disputed. Our South African resources explain international child custody, care and contact, international child relocation and the consequences of international child abduction.

What documents should you gather before the first consultation?

  • marriage certificate and antenuptial or prenuptial agreement;
  • passports, citizenship and UAE residence documents;
  • proof of each spouse’s current address and South African domicile or residence;
  • children’s birth certificates, passports and existing parenting orders;
  • South African and UAE property, bank, employment, company and investment records;
  • pension, provident, gratuity and benefit statements;
  • evidence of current income and household expenses;
  • details of any proceedings, notices or family-guidance process already started; and
  • a chronology of moves between South Africa and the UAE.

Early document collection helps answer the forum question before costs are incurred in the wrong court. For budgeting variables, see international divorce costs and delay factors in South Africa.

What should the first forum assessment deliver?

A proper assessment should end with a usable route, not a generic recommendation to choose a country. It should identify:

  • the evidence supporting South African jurisdiction and any UAE forum that requires investigation;
  • the likely matrimonial-property issues and which country’s advice is needed on each;
  • the filing sequence and court-authorised service plan;
  • an asset-by-asset enforcement map for South Africa and the UAE;
  • the immediate safeguards required for children, travel, passports or threatened asset transfers; and
  • the work to be done by South African lawyers, UAE counsel and any relevant bank, employer, company or registry.

Frequently asked questions

Can I divorce in South Africa if my spouse lives in Dubai?

Yes, if a South African court has jurisdiction under section 2 of the Divorce Act. Your spouse’s residence in Dubai does not prevent the divorce, but court-authorised service abroad is required.

Does my spouse have to return to South Africa for the divorce?

Not necessarily. If the South African court has jurisdiction and the spouse is properly served, the matter can proceed without the spouse travelling to South Africa. A defended case may require procedural arrangements for evidence and participation.

Is it better to divorce in South Africa or Dubai?

It depends on the parties’ legal connections, religion and nationality, the marriage’s property regime, where the children and assets are located, and where the order must be enforced. Compare the likely consequences before filing.

Can a South African divorce order transfer property in Dubai?

Do not assume it can do so directly. UAE property and institutions are governed by UAE law and procedure. Local recognition, an executory formula, additional orders or conveyancing steps may be required.

Must South African documents be translated for Dubai Courts?

Dubai Courts’ published guidance states that foreign documents used in its processes must be legally translated into Arabic and certified through the relevant authorities. Confirm the current requirements for the particular case and document.

Can I take my child from Dubai to South Africa during the divorce?

Do not relocate or retain a child across borders without the required consent or court authority. Urgent advice is necessary because custody, guardianship, travel restrictions and the child’s habitual residence may all be relevant.
